Cattany <br />y <br />c <br />so <br /> Division Director <br /> Natural Resource Trustee <br />RE: Acceptance of Reclamation Cost Estimation Provided by Applicant. <br />On April 6, 2009, the Division accepted the reclamation cost estimation, provided by the Applicant <br />and totaling $8,452, for AM-01 to the Mott Gravel Pit operation. The Division's determination to <br />accept the Applicant's cost estimation was based upon the following factors: <br />1. The Applicant's cost estimation, totaling $8,452, addressed the point of maximum <br />disturbance, as required under Rule 6.3.4(2). The; cost of reclamation associated with the point of <br />maximum disturbance appeared significantly greater that the current reclamation liability, as <br />calculated by the Division on March 12, 2008 and totaling $4,560. Pursuant to Rule 4.2.1(4), the <br />Division cannot require financial warranty greater than current reclamation costs. Therefore, the <br />$8,452 financial warranty proposed by the Applicant appeared to be significantly greater than the <br />amount of financial warranty the Division could require. <br />2. On March 26, 2009 the DSL service to the Durango Field Office was terminated. Durango <br />staff access to the reclamation cost estimation software is provided through the DSL service.
