• Richard T. Raines
March 27, 2009
Page 5
attached Table 1. Should the lagged depletion from any of the pits exceed the values listed in
Table 1, an amendment will need to be filed with this office.
3. All pumping for dust control shall be measured in a manner acceptable to the division engineer.
4. The applicant shall maintain daily records of all diversions, replacements, and the amount of
water used for each particular purpose. The applicant shall provide a report of these records to
the division engineer and the water commissioners on a monthly basis on a form approved by
them. The accounting must be submitted within thirty (30) calendar days of the end of the month
for which the accounting is being made. Failure of the Applicant to provide timely accounting to
the water commissioners may result in revocation of this SWSP.
In addition, the applicant shall submit a report from each entity making replacements; for this
plan, that entity is the City of Aurora. The report shall include an accounting of all wastewater
plant water effluent controlled by each entity, showing the total volume of water under its control
at the various wastewater treatment plants, and the amount committed to each of the recipients
of the water.
5. All releases of replacement water must be sufficient to cover all out of priority depletions and be
made under the direction and/or approval of the Water Commissioner(s). The replacement may
be aggregated to maximize beneficial use. The Water Commissioner(s) and/or Division Engineer
shall determine the rate and timing of an aggregated release.
6. The replacement water, which is the subject of this plan cannot be sold or leased to any other
entity. As a condition of subsequent renewals of this substitute water supply plan, the
replacement water must be appurtenant to this site until a plan for augmentation is obtained. A
copy of this approval letter should be recorded with the county clerk and recorder. All
replacement water must be concurrent with depletions in quantity, timing, and locations. The use
of replacement water must be in compliance with all agreements with the providers of
replacement water.
7. Due to a change in administration of evaporation from ground water exposed to the atmosphere
prior to 1981, pre-1981 credits will no longer be allowed for gravel pits which exposed ground water
to the atmosphere prior to 1981 and were actively mined on or after January 1, 1981. Accordingly,
evaporative depletions for such gravel pits will need to be replaced from the entire surface area of
the ground water exposed in the pits. In order to allow owners and operators of the affected pits
time to comply with this change in the administration requirements, the owners and operators will
have until January 1, 2010 to comply with the replacement requirements. If the area included in the
DRMS mining permit site contains individual gravel pit ponds that were not altered or mined after
December 31, 1980, you may still be able to maintain the "pre-81" credit provided you can
document when mining in the individual ponds ceased. The Applicant is hereby notified that in
accordance with the above described change in administration, the evaporation from
ground water exposed prior to 1981 must be replaced after January 1, 2010 in any
subsequent SWSP renewal for Howe Pit.
8. Dewatering at the pits will produce delayed depletions to the stream system. As long as the pit is
continuously dewatered, the water returned to the stream system should be adequate to offset
the depletions. However, once dewatering at the site ceases, the delayed depletions must be
addressed. At least three years prior to completion of mining, a plan must be submitted that
specifies how the post pumping dewatering depletions (including refilling the pit) will be replaced
