<br />We have received your letter of August 27, 2008 and the additional information received on
<br />March 4, 2009 requesting renewal of the substitute water supply plan ("SWSP") to cover depletions
<br />caused by gravel mining operations at multiple mine sites operated by Lafarge West, Inc. ("Lafarge" or
<br />"Applicant") along the South Platte Riv;owe This SWSP proposes to replace depletions which occur at
<br />eight different mine sites, specifically: Pit, M-78-052 (WDID 0203009), 2) the Tanabe Pit, M-00-
<br />002 (WDID 0203010), 3) the Dunes Development, M-99-093 (WDID 0203011), 4) the Mann Lakes, M-
<br />82-147 (WDID 0203012), 5) the Ft. Lupton Pit, M-85-088 (WDID 0203013, 6) the Riverbend Operation,
<br />M-00-016 (WDID 0203014), 7) Stagecoach Stop Property, M-83-067 (WDID 0203015), and the Fort
<br />Lupton Lakes, M-04-078 (WDID 0203041). The required fee of $257 has been submitted for Howe Pit,
<br />the Mann Lakes, the Ft. Lupton Pit, the Riverbend Operation, Stagecoach Stop Property, and the Fort
<br />Lupton Lakes. The State Engineer approved the clay liner for the Tanabe Pit and Dunes Development,
<br />which eliminated the need to replace new depletions from the evaporation of exposed ground water.
<br />Because the Tanabe Pit and 'Dunes Development have been lined, are no longer operating, and no
<br />longer exposes ground water to the atmosphere, you did not request a separate substitute water supply
<br />plan for the Tanabe Pit and Dunes Development. However, since depletions from the evaporation of
<br />ground water from the Tanabe Pit and Dunes Development (evaporation of exposed ground water
<br />before the pits were lined) are lagged to the stream, the Applicant is required to continue to replace
<br />these lagged depletions. According to the information received on March 4, 2009 Lafarge sold the
<br />Stagecoach Stop Property to Albert Frei and Sons in February 2009, therefore Lafarge will not make
<br />replacements for this site after March 2009. The replacement requirement for this site beginning in April
<br />2009 will be the responsibility of Albert Frei and Sons. A schedule of the lagged depletions from the
<br />Tanabe Pit, Dunes Development and Stagecoach Stop Property is identified in the attached Table 1.
<br />According to condition no. 10 of the previous approval The Applicant was required to
<br />demonstrate that prior to further plan approvals the Fort Lupton site was being lined or
<br />backfilled or that an application for a plan of augmentation has been filed with the water court.
<br />According to the information provided the Fort Lupton site is a "permitted reserve site" therefore
<br />depending on the economic conditions mining may start anytime.
