Exhibit D <br />Response to letter dated November 3, 2008 from Division of Reclamation, Mining and <br />Safe 1y. <br />(9) During reclamation the top soil previously stock piled, will be spread on the 3:1 <br />sideslopes of the pit and also used to restore the swale ditches to existing grade prior to <br />seed and mulching. <br />(10) Top soil removed is approximately 12 inches in depth. This material will be <br />replaced on the disturbed area to an approximate depth of between 6 and 12 inches. <br />(11) The original submittal was in error due to a typographical error. The application <br />rate for "Little Blue Stem" has to be corrected to 2.0 Pls #/Ac. <br />(12) The mulch type planned for use is Oat Straw, as recommended by the District <br />Conservationist. <br />(13) Point of maximum disturbance will be when one pit is completely open so the <br />affected area would be 4.59 acres (400 x 500). Only one pit at any one time will be in <br />operation. This may occur 7 to 8 years into the operation. <br />(14) The pits will be mined using 3H:1 V side slopes. The only material removed, other <br />than the gravel, will be the 12 inches of topsoil which will be completely used during <br />reclamation. <br />(15) Owner to complete finish grading prior to seed and mulch. Cost of finish grading <br />and topsoil replacement is $3,000.00
