The Division determined that no <br />emission permit will be required for the above referenced source since the production rate will be 70,000 tons per year <br />or less. An Air Pollutant Emission Notice, is required, however, since uncontrolled emissions of particulate matter will be <br />more than 2 tons per. year. ; <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness of information <br />supplied by the applicant and is conditioned upon construction, installation, and operation ?in accordance with this <br />information and with representations made by the applicant or the applicant's agents. Specifically, this exemption has <br />been granted provided that the following information is accurate and complete: <br />1. The production rate does not exceed 70,000 tons per year. Annual records of the actual production rate shall be <br />maintained and made available to the Division for inspection upon request. <br />The applicant shall follow the fugitive dust control plan as submitted with the application. <br />Any changes with respect to the original submittal that would result in an increase in production above 70,000 tons per <br />year automatically nullify this exemption. Before actually making any such change, you must apply to the Division for a <br />construction permit based on the anticipated change. A permit must be obtained BEFORE implementing the change. <br />A Revised Air Pollutant Emission Notice (APEN) shall be filed (Reference: Reg. 3, Part A,II.C): <br />a. Annually whenever a significant increase in emissions occurs as follows: <br />A change in actual emissions of five tons per year or more of particulates or PM,o, above the level <br />reported on the last APEN submitted; or <br />b. Whenever there is a change in the owner or operator of any facility, process, or activity; or. <br />C. Whenever new air pollution control equipment is installed, or whenever a different type of <br />` .. control equipment replaces an existing type of control equipment; or <br />AIRS ID: 041/2025/001 ver. 12/08
