The peimittee shall <br />prepare and submit a Sediment Control plan by duly 1, 2009_ The Division will review the Sediment Control Plan and approve it_ Once <br />approved by the Division, the Sediment Control Plan will become a part of this permit certification by reference. <br />Compliance Schedule for Sediment Control Plan for ReclanuidionAreas <br />Code 12505 A Sediment Control Plan shall be prepared and submitted by July 1. 2009 for the Reclamation Areas as required under Part <br />1.13_3_b_ of the CDPS General Permit for Coal Mining Facilities and 40 CFR 434.82- The plan required by this compliance schedule shall <br />be directed to the industrial Unit of the Permits Section for final review- <br />Code Erwif Description Permit Citation Due Date <br />12505 Submit Plan Submit Sediment Control Plan Part 1 B_3. b. 07101109 <br />Other Conditions <br />Anode anon <br />Antidegradation review does not apply to this permit because limitations based on Water Quality Standards are not applied in this <br />certification <br />Groundwater Contamination <br />If groundwater contamination is encountered then the petmittee is to contact the Division, cease all discharges, and if appropriate, <br />contact the owner of the collection system receiving the discharge. Since the dischaW of contaminated groundwater is not covered <br />under this permit, the permittee shall immediately apply for a groundwater remediation certification, which will include appropriate <br />requirements for additional discharge monitoring and on-site environmental response capabilities- <br />Sampling <br />Sampling shall occur at a point after treatment, or aQer the implementation of any Best Management Practices (BMPs). If BMPs or <br />treatment are not implemented, sampling shall occur where the discharge leaves control of the permittee, and prior to entering the <br />receiving stream or prior to discharge to land. Samples must be representative of what is entering the receiving stream. <br />Monitorins! and Reporting <br />Discharge Monitoring Reports (DMR) roust be submitted monthly as long as the certification is in effect- The permittee shall provide the <br />Division with any additional monitoring data on the permitted discharge collected for entities other than the Division This will be <br />supplied to the Division within 48 hours of the receipt of the data by the permittee_ <br />Best Management Practices <br />The permittee shall implement and maintain the Best Management Practices (BMP) for the prevention of erosion and the control of solid <br />and liquid ;pollutants due to the discharge. BMPs include various options, such as: modification of the pipe discharge structure to disperse <br />flows; containment of water by hay bales or other comparable structures; the use of geocloth, filter fabric, or plastic sheeting for protection <br />of containment structures; rip-rap-, and/or any other approved methods. <br />The General Permit for Coal Mining is attached and the permittee should review this perinit for familiarity with all of the permit <br />requirements.
