Cattany <br />Division Director <br />Natural Resource Trustee <br />Janet, as per your email request dated March 27, 2009 1 have completed my adequacy <br />review for Technical Revision No. 66 (TR-66) for the Foidel Creek Mine, #C-82-056. I added <br />one question (multi-part, albeit) to your adequacy letter and forwarded it to the applicant. <br />The applicant has provided adequate information to comply with Rule 2.05.3(4) for Ponds, <br />impoundments, other treatment facilities, and diversions, and the associated performance <br />standards of Rules 4.05.6 and 4.05.9. I'll leave it to you to check Exhibit 25Y to ensure that <br />the applicant has demonstrated a safety factor of 1.3 can be achieved for the sediment ponds <br />(Rule 4.05.9(8)(b). <br />One question that is really more of a clarification is related to topsoil removal timing of the <br />disturbed area. One page 2.05-45.6h the applicant states "Following soil removal, required <br />drainage and sediment control structures will be constructed or installed". Based on the <br />sequence of events provided on page 2.05-45.6g, I assume they mean topsoil removal for <br />the sediment ponds disturbed area as opposed to the ventilation pad disturbed area and <br />additional upstream areas. The sediment ponds and associated sediment control measures <br />are required to be constructed and in-place prior to any other watershed disturbance <br />activities. This includes construction and as-built certification. Once ponds and other <br />measures are in-place, and certified as constructed as designed, the remaining facilities can <br />be constructed, beginning with topsoil removal of those additional areas. <br />Let me know if you have any other questions. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
