The problem or possible
violation is the potential exposure of groundwater.
As you now know from telephone conversations with me and Noble Underbrink (Head,
Collections Systems Department of the west slope facilities), the reason for the two dewatering
trenches at the quarry is to redirect irrigation water from the quarry. The NCWCD owns the
property surrounding the quarry and has entered into a lease agreement on that property. As part
of the lease agreement, the lessee has the right to irrigate portions of the NCWCD's property
with water shares owned by the NCWCD from the Red Top Ditch. The enclosed pictures show
that irrigation can be done on property located north of the quarry site. Since the quarry is
located below the irrigated field, the NCWCD needed to construct the two trenches to minimize
water within the quarry site.
The NCWCD has met with Neil Misbach, Water Commissioner with Division 5, State
Engineer's Office to determine if any permits are necessary. Mr. Misbach has determined that no
permits are needed in order to continue the dewatering that NCWCD performs within the limits
of the quarry. Mr. Misbach will be sending a letter to you addressing his findings regarding the
trenches the NCWCD has put within the limits of the quarry.
if you have any additional questions, you may contact me at 970-622-2243.
Sincerely,
Jim L. Stru e, SR/WA
Senior Rights-of-Way Agent
nk
Enclosures
cc: Noble Underbrink
