2 <br />MINE ID # OR M-1981-086 I INSPECTION DATE: 08/15/2006 I INSPECTOR'S BMW <br />PROSPECTING ID #: INITIALS: I <br />OBSERVATIONS <br />This inspection was conducted as part of the Division of Reclamation, Mining and Safety (Division) monitoring <br />program. Present at the inspection was Richard Wenzel of the Division. Jim Struble of the Northern Colorado <br />Water Conservancy District was contacted prior to the inspection but was unable to be present. However, he <br />indicated that Noble Underbrink would be available if necessary; he was not contacted. <br />A sign was posted at the entrance to the site, which was secured by a metal gate and permit boundaries were <br />identified. <br />Topsoil is stockpiled in the southwest comer of the site and is well vegetated. A berm has been constructed along <br />the east and west sides of the site to contain any surface drainage. However, the berm has been breached by <br />erosion at one location along the west side of the site. This erosion is listed as a problem on page three of this <br />report and is documented by a photograph on page four. <br />At the north end of the site, two dewatering trenches have been excavated from east to west across the site. <br />Groundwater was observed to be flowing from east to west in both trenches. The trenches join near the west side <br />of the site and the ground water flows into the adjacent field. A review of the existing permit indicates that exposure <br />of ground water is not anticipated and that dewatering will not be necessary. In accordance with Rule 3.1.6(1), <br />disturbance to the prevailing hydrologic balance of the affected land shall be minimized both during and after mining <br />by complying with Colorado water laws and regulations governing injury to existing water rights. Therefore, the <br />Division requests that the operator backfill the existing dewatering trenches to a level two feet above the ground <br />water level or, if the operator desires to continue to expose ground water, contact the Office of the State Engineer to <br />determine if a well permit or water augmentation plan is required for the exposure of ground water. In addition, if <br />the operator desires to continue dewatering the site, the Division will require the operator to submit a revision to the <br />permit to include the dewatering plan and any changes to the reclamation plan.
