Follow-up on Unresolved Problem at Borrow Area C; Permit Num ber M-1981-086 <br />Dear Mr. Struble: <br />The above-mentioned site has had one or more problems noted that, according to Division of Reclamation, Mining and <br />Safety (Division) records have not yet been resolved. According to our records, the following problem was to be <br />resolved on or before September 23, 2006. Listed below are descriptions and corrective actions for the problem. Please <br />resolve the corrective actions and provide evidence of such resolution on or before June 1, 2009. <br />Please note that if the corrective action is not properly addressed, and evidence provided to the Division by the date <br />provided above, the listed problems could be escalated to the level of possible violations and would then be referred to <br />the Mined Land Reclamation Board for further action. <br />• Ground water has been exposed in the two dewatering trenches at the north end of the site. <br />CORRECTIVE ACTION: <br />In accordance with Rule 3.1.6(1), disturbance to the prevailing hydrologic balance of the affected land <br />shall be minimized both during and after mining by complying with Colorado water laws and <br />regulations governing injury to existing water rights. Please backfill the existing dewatering trenches to <br />a level two feet above the ground water level and, if the operator desires to continue to expose ground <br />water, contact the Office of the State Engineer to determine if a well permit or water augmentation plan <br />is required for the exposure of ground water. Once the trenches have been backfilled to two feet above <br />the ground water level, submit photographs of the backfilled trenches to the Division by the correction <br />date. As an alternative the operator may obtain a gravel well permit from the Office of the State <br />Engineer allowing him to expose ground water. If the operator chooses this option, the Division will <br />require the operator to submit a revision to the permit to include the dewatering plan and any changes <br />to the reclamation plan. <br />If the problem has already been remedied, please provide evidence of its completion.
