4-18 <br />• 4.2.4 <br />~ The operator conducted an additional year of baseline water sampling <br />from September 1985 through September 1986. The results of sampling were <br />sent to the Division each quarter. A tabulation of the data collection is shown in <br />Table 4.2ii. <br />4.2.5 Water Rights <br />All water used in the mining and pollution control operations will be <br />obtained from the Colorado River near Loma. The Operator has a first and prior <br />right to 10 cfs of water from the Mack Pumping Pipeline as set forth in C.A. No. <br />13368, Mesa County District Court by decree, April 13, 1972 and as modified <br />May 29, 1974 (See Appendix C). Consumptive use is discussed in Section 2.4.3. <br />Rule 2.04.7 requires that the applicant provide well locations and reported <br />yields for all wells within the permit area and adjacent areas. There are three <br />wells in a 2-mile radius, permit no. 32752, permit no. 254049 and permit no. <br />256862. Wells 32752 and 254049 are listed by the State Engineer as <br />abandoned and therefore have no yield. Well 256862 is active and has a yield of <br />5 gpm. <br />Rule 2.04.7 also requires that the applicant provide information on water <br />~l supply intakes, ditches, reservoirs, and wells within one mile of the affected area. <br />/1 The only such structure is the H.F.
