III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 23 March 2009. The weather was cloudy and snowing <br /> and the mine site was wet and snow covered during the on-the-ground inspection of the site. There <br /> was a substantial amount of snow cover throughout the mine site and access to the entire mine site <br /> was limited. A portion of the inspection was conducted from County Road 29 to the west of the mine <br /> site. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were located and inspected at the Routt <br /> County Courthouse in Steamboat Springs, CO. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south, the access road off of County Road 78, the Oak Creek Facilities Area and the North Road <br /> entering the mine area from the north. All mine I.D. signs were in compliance with all required <br /> information displayed and no problems noted at the time of the inspection. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were covered with a substantial amount of snowfall and access was <br /> either limited or inaccessible. Portions of the North Road the Old Tipple Road, Lower Moffat Road, <br /> Center Ridge Pond Road, West Ridge Pond Road, and West Ridge Road were inspected from <br /> County Road 29. All roads were stable with no problems noted at the time of the inspection. Culverts <br /> and roadside ditches were snow covered. <br /> Hydrologic Balance <br /> All sediment ponds appeared to contain frozen water with substantial ice and snow cover evident. All <br /> embankments appeared to be stable with no visible signs of erosion or damage. <br /> The Moffat Pond, Center Ridge, and West Ridge ponds were frozen at the time of the inspection. All <br /> embankments were snow covered and stable with no problems noted. The primary spillways were <br /> functioning as permitted and the emergency spillways were in compliance with no problems noted at <br /> the time of the inspection. <br /> The four Moffat down drains were covered in snow and stable with no evident signs of damage. No <br /> water was observed flowing in the drains at the time of the inspections. <br /> The "string-of-pearls" permanent drainage channel contained was completely covered with snow. The <br /> area appeared to be stable with no signs of damage. <br /> Support Facilities <br /> Due to the substantial amount of snow cover, the permanent buildings at the mine site were <br /> inaccessible. These buildings were observed from County Road 29 and no problems were noted. <br /> The permanent office located on Old Tipple Road was observed off of state highway 131 and <br />
