O. l~x 1430 <br />Palisade, CO 81526 <br />Gentlemen: <br />TransCotorado~ as Transmission Company (Trans~"olorado) has been issued right-of--way <br />grant No. COC-51280 6 the United States Bureau of Lapd Management across public lands for a <br />natural gas transmission line\ The route selected for the 1'ne will cross lands on which Powderhom <br />Properties Company holds fe eral coal lease number 0 538. <br />The natural gas transmis 'on line will cro within the coal lease area in Section l8, <br />Township l 1 South, Range 97 Wes Sixth Princip Meridian, Mesa County, Colorado <br />• The right-of -way grant to be is~st~ed to T ansColorado will contain a stipulation that will <br />provide that the existence of the gas ttazumr stun ne shall not prevent the mining of any coal under <br />the leases. The Colorado surface Coal Mini tg eclamation Act prevents mining operations from <br />disturbing surface facilities. <br />TransColorado acknowledges that i rig swill be subject to the above right-of--way <br />stipulation in favor of mining activities and r Powd horn's coal leases and agrees to analyze the <br />impact of the mining activities on its gas mission ipeline and, if necessary, relocate the line <br />if it is determined that it will interfere with a operatio under said line.
