<br />,~ . <br /> <br />notice to Proceed (Continued) <br />C-29423 <br />August 15, 1985 <br />The authorized officer shall notify the holder of right-of-way C-29423 if at any <br />time it appears that the Mine Plan filed in conjunction with mining activities <br />under Federal coal lease C-029889 must be modified to provide protection for the <br />electric transmission facilities authorized herein as required by the Colorado <br />Surface Coal Mining Reclamation Act (CRS 34-33-101, et seq.), or other law, rule <br />or regulation. Upon such notification, the holder shall then be given 90 days <br />from the receipt of such notice to initiate such changes as necessary in the <br />location, operation, and/or structural design of the facilities authorized <br />herein which will allow coal mining operations to proceed ih accordance with <br />the Mine Plan without modification due to facilities authorized by the R/l•J <br />grant. AT1 costs associated with such changes to the electric transmission <br />facilities shall be borne by the holder. If the location, operation, and/or <br />structural design of the electric transmission facilities cannot be changed <br />so as to allow coal mining operations to proceed in accordance with the Mining <br />Plan without modification due to facilities authorized by the rignt-of-way <br />grant, tTie holder shall remove the facilities from the area impacted by mining <br />operations under Federal coal lease C-029889. Removal of the facilities <br />authorized herein shall be without liability or expense to the Uniteo States <br />or the lessees of the aforementioned Federal coal cease, their successors, and <br />assigns. <br />U <br /> <br />
