Box 1430 <br />Palisade, Colorado 81526 <br />Gentlemen: <br />fLWle Ssrviu <br />Compsoy of Colorado <br />October 1, 1988 <br />Public Service Company of Colorado (Public Service) has made <br />application to the United States Bureau of Land Management for a <br />right-of-way grant across public lands for an overhead electric <br />transmission line. The route selected for the line will cross lands on <br />which Powderhorn Properties Company holds federal coal lease number 01538. <br />The electric transmission line will cross the following parcels of <br />land within the coal lease areas: <br />• Sixth Principal Meridian <br />W}NW} Section 28,.Township 10 South, Range 98 West <br />N}NE};SW}NE}; <br />NW}SE};E}SW}; Section 29, Township LO South, Range 98 West <br />SW}SW} <br />NW}NW} Section 32, Township 10 South, Range 98 West <br />The right-of-way grant to be issued to Public Service will contain a <br />stipulation that will provide that the existence of the electric <br />transmission line shall not prevent the mining of any coal under the <br />leases. The Colorado Surface Coal Mining Reclamation Act prevents mining <br />operation from disturbing surface facilities. <br />Public Service acknowledges that its rights will be subject to the <br />above right-of-way stipulation in favor of mining activities under <br />Powderhorn's coal leases and agrees to relocate its electric transmission <br />line upon notification from Powderhorn that its line will interfere with <br />mine operations under said line.
