• <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMNIISSIONERS IN THE COUNTY OF MESA, STATE OF COLORADO: <br />THAT the request for a Conditional Use Permit to operate a sand storage facility, <br />with an exception to the height limitations in the AFT District, located at 3970 I 9/10 Road is <br />approved with the following conditions: <br />1. All review agency comments shall be addressed that are not in conflict with the <br />conditions of approval. <br />2. The sand storage towers shall be painted and screened as to minimize visual impacts from <br />Interstate 70 and the State Park. Demonstration that visual impacts will be mitigated to <br />the maximum extent possible using all available visual enhancement methods shall be <br />submitted to the Planning Department before construction begins. On-going maintenance <br />shall be provided by the applicant. In addition to painting the towers to match the color <br />of the canyon back-drop as proposed by the applicant the applicant shall either: <br />a. Reduce the height of towers to 85 feet (not including-the conveyor appazatus) <br />with the addition of a fourth tower, if necessary, or <br />b. Utilize screening techniques to simulate the surrounding features. <br />3. Prior to construction, a plan shall be submitted to the Planning Department by the <br />applicant, owner and/or operator committing to the removal of the sand towers and <br />reclamation of the site in the event the sand storage operations aze discontinued. In <br />addition a weed management plan for on-going operations of the facility will also be <br />submitted. <br />4. Upon construction of the sand towers and warehouses, the sand load-out area identified at <br />the temporary un-load roadway will be retained for a secondary load-out area to be used <br />only when other facilities aze not available. Any future use at the load-out area must be <br />in support of the sand storage operations and approved by the Planning Director as a <br />minor modification to the plan. Proposed lay-down azea for trailers, equipment and <br />piping shall be removed from the plan. <br />5. The Individual Sewage Disposal System (ISDS) must comply with Mesa County Health <br />Department regulations. <br />6. The applicant must consult with the Town of Palisade to determine the need to upgrade <br />the existing main from a 4" to an 8" line. The applicant shall demonstrate that this issue <br />has been satisfactorily addressed with the Town. <br />7. The security gate and the proposed bridge are subject to Mesa County Road Access <br />requirements and shall be designed to ensure adequate clearance from the roadway when <br />the gate is closed. <br />8. An emergency management plan shall be prepared and provided to Mesa County and the <br />Town of Palisade. The applicant will be required to demonstrate means for emergency <br />access to the Palisade Fire Department and other emergency responders. Approval for <br />the fire protection plan from the Town of Palisade shall be submitted to the Planning <br />Depaztment prior to commencement of construction. <br />9. Continued management of the site will be required as a means to control noise and dust in <br />accordance with the local, state and federal standards. <br />• 10. Prior to construction, the applicant shall produce evidence of compliance with the <br />Colorado emissions standards by means of an Air Pollution Emission Notice (APEN) or <br />PR-4 A15-2-21 (New 12/08) <br />
