Box 1430 <br />Palisade, Colorado 61526 <br />Re: Surface Owner Consent for Roads - Roadside Mine <br />Dear Mr. Reschke: <br />TAIO:~ ~ <br />PRfDEIN~ <br />~ ~ <br />By letter of October 21, 1996, you requested that BLM sign a consent form <br />pertaining to leaving certain access roads open subsequent to the mining and <br />reclamation operations. The request is in response to questions raised by the <br />Division of Minerals and Geology during the mid-term review of the mine <br />permit. <br />• This letter will serve to provide our consent and explain our position on the <br />use of BLM roads within the permit area. The two roads specified in your <br />request which are routinely used by Powderhorn include Haul Road 4 (Coal <br />Canyon access) and Access Road 3 (2 West Portals access). Other roads within <br />the mine permit area are used on a casual basis. <br />Haul Road 4 - This segmenC of road is located in sections 27 and 28, T. 10 S., <br />R. 98 W. on Powderhorn-owned surface (see map). In 1989, Powderhorn granted a <br />road easement to BLM (Tract No. C-40279) for the purpose of having public <br />access into the Coal Canyon area. The easement is perpetual and exclusive, <br />but reserves ingress and egress to the grantor. Our goal is to continue to <br />leave the road open in the foreseeable future for public access to BLM lands. <br />The current use and any future upgrading of the road by Powderhorn is <br />acceptable to BLM provided that public access is maintained in the same manner <br />and degree which currently exists. <br />Access Road 3 - This segment of road is located in sections 2 and 11, T. 11 <br />S., R. 98 W. on BLM lands (see map). It is used to access the 2 West Portals <br />of the Roadside South Mine and also by the local rancher. The road begins on <br />private land and is closed to the public by a locked gate where it intersects <br />the main road in section 2. Access Road 3 terminates in the drainage just <br />below the 2 West Portals site. Since this was an existing road with minimal <br />upgrade by Powderhorn, the BLM would not require post-mining reclamation. <br />However, BLM reserves the right to require post-mining reclamation should the <br />existing road be substantially modified or reconstructed by Powderhorn. <br /> <br />7 <br />
