Binns <br />Environmental Protection Specialist <br />Division of Reclamation, Mining, & Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RECEIVED <br />A 2 '- 2009 <br />Mining and Safety <br />Re: Foidel Creek Mine (Permit No. C-1982-056) Technical Revision Application No. 66 (17R-66) 18- <br />Left Shaft Installation & Associated Ancillary Equipment and Facilities (CHS #54397) <br />Dear Ms. Binns: <br />Thank you for your correspondence dated March 11, 2009 (received by our office on March 13, 2009) <br />regarding the subject project. <br />Following our review of the documentation provided, it is our opinion that a finding of "no historic <br />properties affected" is appropriate for the 18-L Shaft activities proposed in Sections 22 and 23, <br />Township 5N, Range 87W based on the negative results of the cultural resource inventory. <br />Should unidentified archaeological resources be discovered in the course of the projects, work must be <br />interrupted until the resources have been evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
