III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. The reclaimed mine site was free of any snow cover. <br /> Roads <br /> The county road going up the Hubbard Creek canyon to the mine site was dry and in good shape.The mine road <br /> across Hubbard Creek that leads to the main site also was dry and passable.The entrance gate was closed and <br /> locked.The light use road to reclaimed pond 5 was passable as well. <br /> Signs and Markers <br /> The mine ID sign was on the entrance gate and contained the correct information.Also on the entrance gate was <br /> the"records location"sign. Surface disturbance markers were up around the disturbed area. <br /> Reclamation <br /> The reclaimed mine slopes and benches were stable.No evidence of slope instability or erosional gullies was <br /> evident.There were a few locations on the north area backfilled slopes where seeps were observed.The slopes <br /> and terraces were well vegetated.There was positive drainage off of the reclaimed benches.The diversion <br /> ditches carrying runoff from the reclaimed benches and around the reclaimed slopes had sufficient capacity. <br /> Water was dripping out of the north and south underdrains while the central underdrain was dry.There were no <br /> erosional gullies at the reclaimed pond 5. The reclaimed pond's silt fence was up at the down slope end kid was <br /> properly anchored. <br /> The reclaimed coal stockpile area was also stable. The upland diversion ditch had sufficient capacity.The entire <br /> area had a good vegetative cover.Two sections of black plastic culverts remain on site but will be removed. The <br /> silt fence was properly installed at the downgradient end of reclaimed pond 4.There were no indications of <br /> erosional gullying at this site. <br /> c:/word/blueribbon/insp0309 <br />
