III. COMMENTS-COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the operator. There was no snow cover at the loadout. Roads The paved haul road was in good condition.The guard rail was in place. The light use road along the railroad tracks was dry and passable. The east side graveled road also was in good condition. The east gate was open. Facilities There was a moderate amount of coal that was stockpiled on the bench,next to the grizzly. The coal fines pile was small in volume.No haul trucks were unloading but coal rail cars were being loaded during the inspection. There were no signs of fugitive dust going offsite.No coal dust was seen being tracked onto the highway. The berm on the outside edge of the facilities bench was in place and had enough height.No problems were observed at the substation,material storage area and coal handling structures.There were no fuel leaks at the fuel facility. Hydrology The west side dugout pond was dry. The single channel open spillway was clear of debris. There was a little standing water in the east side sediment pond.The gate on the primary discharge pipe was closed.The pond embankment was well vegetated.The emergency spillway was clear of debris. The straw bales and silt fence were in place at the railroad track small area exemption. Topsoil The east side topsoil stockpile had a good vegetative cover. The topsoil signs were up. The west side topsoil stockpile also was well vegetated. Topsoil stockpile signs were up on this stockpile as well. There were no erosional problems with either of the two topsoil stockpiles. c:/word/terror/insp0309
