III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. There was no snow cover at the reclaimed mine site although some areas were a little <br /> muddy. <br /> Roads <br /> The paved haul road was in good condition,as was the bridge across the North Fork of the Gunnison River.The <br /> entrance gate was open.The"no trespassing" sign was on the gate. <br /> Hydrolo�y <br /> The hillside spring water treatment pond was discharging at about 10 to 15 gpm.The color of the discharge <br /> water was orange.The water has been shown in the past to be in compliance with water quality standards. <br /> The hillside spring water was flowing into the channel which leads to the treatment pond.The temperature of <br /> the spring water was 100 degrees F at a point about 10 feet below the origin in the hillside. <br /> There was only a little standing water in the sediment pond. The primary discharge pipe gated valve was in the <br /> closed position.The emergency spillway was functional,with riprap in place. <br /> The collection ditch leading into the sediment pond had sufficient capacity. The river protection berm had <br /> sufficient height.No problems were noted with the two alluvial wells. <br /> Reclamation <br /> The reclaimed portal road was well vegetated and was stable.The reclaimed fan site was also stable and had a <br /> good vegetation stand. However,the backfilled and graded west side portal area continues to show evidence of <br /> slope instability. <br /> Noxious Weeds <br /> Tamarisk is growing in the hillside treatment pond and needs to be dealt with appropriately. <br /> Facilities <br /> Concrete sections from the mine office building remain on site.The concrete pad needs to be broken up and <br /> removed as well. Some debris around the site also needs to be removed, as well as two power poles. <br /> c:/word/bear3/insp0309 <br />
