Cattany <br /> <br />Trinidad <br />CO 81082 Division Director <br />, Natural Resource Trustee <br />RE: 2008 ARR Review, Lorencito Canyon Mine, #C-96-084 <br />Dear Mr. Thompson: <br />The Division of Reclamation, Mining, and Safety has completed review of the 2008 Annual <br />Reclamation Report (ARR) received March 16, 2009 for the Lorencito Canyon Mine, #C-96-084. <br />Please find attached a copy of the ARR form filled out with values that the Division believes <br />represent the current conditions at the Lorencito Canyon site. You will notice a few changes in <br />some categories, discussed in more detail below. <br />An industrial bond release (SL-02) was approved in April 2008 that was a Phase I, II, and II <br />release for 27.2 acres comprised of the loadout and pond 10 (4.5 ac), the service area (.4 ac), <br />the office area (.5 ac), and haul and access roads (21.8 ac). Please be advised that the value to <br />be reported for each land status category is for bonded acres only. Therefore, the value for <br />acres disturbed should be 155.6 - 27.2 = 128.4. Since only one (1) acre at the loadout and .4 <br />acres at the service area were reported as topsoiled, only 1.4 was subtracted in the backfilled <br />and graded category, the topsoiled category, and the seeded category, resulting in a value of <br />122.1. <br />When one subtracts 122.1(8 & G) from 128.4 (disturbed) a value of 6.3 acres remains. This is <br />the acreage of the long-term facilities comprised of the remaining sediment ponds, (4.5 ac) and <br />the borrow area (BA-3) yet to be reclaimed (1.8 ac). Please note that the acreage yet to be <br />reclaimed is a subset of the acreage in long-term facilities. <br />The acreage in long-term facilities + the acres in active mining + acres backfilled and graded <br />must equal the total disturbed acres. In this case, 6.3 + 0.0 + 122.1 = 128.4. <br />For the life of mine, the total disturbed acres is 155.6 of which 149.3 have achieved a Phase I <br />release, 27.2 Phase II release and 27.2 Phase III release. <br />Please review and re-submit a new 2008 ARR form.
