OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1) County High Impact Permit - A High Impact Permit is needed with Montezuma County. The <br />County High Impact Permit has already been granted. <br />2) NPDES combined process water/storm water discharge permit - A NPDES permit will not be <br />needed from the Colorado Department of Public Health and Environment since water will not <br />leave the site. <br />3) APEN - A fugitive air emissions permit is needed from the Colorado Department of Public <br />Health and Environment since the site will mine more than 70,000 tons per year. Air emissions <br />permits will be in place for all portable equipment utilized on site which requires a permit. The <br />APEN has not yet been submitted. <br />4) A Substitute Water Supply Plan for the Division of Water Resources is needed for the <br />operation since irrigation water is going to be used for industrial purposes. This plan is currently <br />being developed. <br />5) A CDOT Road Access Permit will be required for vehicles entering Highway 160. <br />6) A Spill Prevention Control and Countermeasure (SPCC) Plan is not needed for the mining <br />operation since the only tanks that will be located on site will be associated with the individual <br />processing plants. At times when there are no tanks on site with the processing equipment, fuel <br />will be brought to the site with a mobile fueling truck. No spilled material will be allowed to <br />leave the site and all tanks will have secondary containment. In addition, the portable crusher and <br />asphalt plants that will be on site from time to time each have their own separate SPCC Plans. <br />Simmons Pit, March 2009 M-1
