(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2006-032 <br />INSPECTION DATE 3/6/09 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection of the Bellgardt Pit, M-2006-032, occurred simultaneously with an inspection of the old <br />Bellgardt Pit, M-1977-085. The inspection occurred as part of the Division's review process of a request <br />for full release of warranties and termination of the permit (SL-01) for M-1977-085. During the inspection <br />of M-1977-085 the Division determined that all reclamation liability was redundantly permitted and <br />bonded under M-2006-032. Therefore, release of warranties and termination of M-1977-085 was <br />appropriate. On March 6, 2009, the Division approved SL-01 for M-1977-085. <br />Inspection Topics Specific to M-2006-032 <br />The application for the new Bellgardt Pit, M-2006-032, was approved on July 24, 2006. However, the <br />permit was not issued until November 14, 2007, subsequent to the receipt and approval of the $50,213 <br />financial warranty. The Bellgardt Pit is approved for 36 acres affected lands, for the excavation and <br />processing of construction materials. Affected lands will be reclaimed to support pastureland post-mining <br />land use. Surface and subsurface are owned by Margaret Hale. However, mining and reclamation <br />activities are conducted by Western Gravel, Inc. <br />Conditions of the operation appeared similar to those observed and recorded by the Division during its <br />latest inspection occurring on October 26, 2007. Mining and reclamation activities were compliant with <br />permit conditions and the Act and Rules.
