Nuvemco, LLC's Monogram Mine M-1978-222UG <br />Response to Preliminary Adequacy Review <br />March 10, 2009 <br />Section 7, Surface Drainage Structures: <br />Please note that all drainage structures for a DMO must meet the requirements of Rule 7.3.1(3). The structures <br />must be identified on all snaps as well. Please clarify that all structures have been identified and meet the <br />requirements. <br />As described and certified in the preceding section and illustrated by maps and photographs, the <br />drainage structures meet the requirements of Rule 7.3.1(3). <br />Exhibit F Reclamation Plan <br />Rule 6.4.5 <br />Section 1, General Reclamation Plan: <br />Staff suggests that the operator reconsider wording in the mine plan and reclamation plans. Current affected <br />areas are estimated to be 9.4 acres initially. However, if other areas are developed an amendment with all the <br />same requirements currently under review would be necessary. If the wording was changed to the "first phase" <br />will disturb 9.4 of a possible 48.38 acres of disturbance any modifications to the mine and reclamation plans <br />would be technical revisions. This would save considerable time and expense for the operator plus not require <br />any additional public comment periods. <br />Nuvemco has modified the last paragraph of the Introduction on page Introduction - 1 as follows <br />in accordance with the above suggestion: <br />The first phase of the Monogram Designated Mining Operation will disturb 8.3 of a possible <br />48.38 acres of disturbance with any modifications to the mining and reclamation plans to be <br />addressed with technical revisions. <br />Similarly, Nuvemco has modified the paragraph (d) of Exhibit C, on page C - 1 as follows in <br />accordance with the above suggestion: <br />(d) The first phase of the Monogram Designated Mining Operation will disturb 8.3 of a possible <br />48.38 acres of disturbance with any modifications to the mining and reclamation plans to be <br />addressed with technical revisions. Mining operations are estimated to disturb approximately 4.2 <br />acres and the exploration drilling on existing roads and trails will disturb an estimated 4.1 acres, <br />although less than an acre would be disturbed at any time. The exploration drilling reclamation <br />will immediately follow drilling and logging of boreholes. <br />And, Nuvemco has modified paragraph 2, Exhibit E - Reclamation Plan as follows: <br />Phase one of the Monogram Designated Mining Operation will disturb approximately 8.3 of a <br />possible 48.38 acres of disturbance with any modifications to the mining and reclamation plans <br />to be addressed with technical revisions. <br />Phase One Proposed Surface Disturbance. <br />2.2 acres in the Monogram Mine area <br />9
