The Division may require submittal of SPCC plan details sufficient to calcutate a reclamation <br />bond and review of the associated reclamation plan. <br />Mine Site Inspections: <br />As an inspection item, where ground water impacts from a loss of containment may be expected, <br />the mine site operator may need to demonstrate that any contained waters in the spill <br />containment structure do not compromise the ability to store the design storm event. (A <br />Professional Engineer certification of an SPCC plan demonstrates containment capacity <br />requirements.) Removal of accumulated fluids from containment structures must be done in <br />accordance with applicable laws and regulations. The presence or absence of a containment <br />structure or, if applicable, an SPCC plan at a mine site should be an inspection item and so noted <br />in the inspection report. Double walled tanks/convault tanks do not need secondary containment, <br />as it is inherent in the design of the structure. Temporary or portable tanks must abide by <br />appropriate containment requirements and have adequate containment. It is recommended that <br />spill plan site maps be updated as part of the annual report to show the current location of the <br />tank(s). <br />The presence of a slurry wall or other constructed barrier intended to result in a lined reservoir at <br />a construction materials operation is an acceptable alternative to an approval SPCC plan or <br />facility. The Operator must provide the Office documentation that the Office of the State <br />Engineer has approved the constructed barrier in order for the Division to accept the barrier as an <br />alternative. <br />The WQCD should be copied on the inspection report if an SPCC plan or Materials Containment <br />Plan is not available for inspection and it is determined that such plan(s) may be required. <br />(Please see regulated quantities, above.) <br />It is recommended that site placement of the containment structure(s) prevent and/or protect <br />against the loss of the contaimnent structure(s) due to debris or landslides, avalanches, or other <br />- - reasonably anticipated events that could compromise the ability of the facility to contain a- - - - - <br />controlled product spill. Guidance contained herein pertaining to site placement shall only apply <br />to structures constructed after the date this policy is adopted. For existing facilities where site <br />placement bas the potential to compromise containment, the operator may propose structural <br />improvements or operational procedures. The Division will determine on a case-by-case basis if <br />a permit revision is required for the proposed structural improvement(s) in order to prevent <br />and/or protect against the lass of the containment structure(s) due to debris or landslides, <br />avalanches, or other reasonably anticipated events that could compromise the ability of the <br />facility to contain a controlled product spill.
