Box 670 <br />Hayden, CO 81639-0670 <br />Re: Request to leave Permanent Road on Private Property <br />To ~X/laom It May Concern <br />Seneca Coal Company currently holds a surface lease on pardons of your land(s) at the Seneca II Mine in Routt County, <br />Colorado. The Seneca II Mine operates and conducts reclamation under a Colorado Division of Minerals and Geology <br />(CDMG) Mine and Reclamation Permit, Permit C-80-005. As part of the future final reclamation plan, Seneca Coal <br />Company would like to leave several permanent roads across the permitted area. A portion of these proposed <br />permanent roads would cross your property (see attached drawing indicating the road location and property ownership). <br />In accordance with Colorado Mined Land Reclamation Board Regulations fox Coal Mining <br />• Rule 2.05.5(11(61, the postmining land use description shall be aaompanied by a copy of the comments concerning the proposed use by <br />the legal ar equitable owner of record of the rurface of the propored permit area and the State and localgovernment a~encier which would <br />have to initiate, implement, approve, ar authorize the proposed use of the land following reclamation. <br />• Rule 4.03.1(1 l(fl, Al! haul roads be removed and the land acted reclaimed in accordance with the requirementr of 4.03.1(d~') <br />unless: <br />(i) Retention of the road is approved as part of the approved po.rtmining land ure and the mad complier with al! applicable performance <br />standards; and <br />(ii) The landowner requestr to the Division in venting, that the road or certain parts thereof are to be left open far further use. <br />• Rule 4.03.2(11(el, All otters madr be removed and the land a1Tected reclaimed in accordance with the nquiremenu oJ4.03.1(7) <br />unless: <br />(i) Retention of the road is approved as part of the approved portmining land use and the road complier with al! applicable performance <br />standardr; and <br />?) The landowner requests to the Division in writing, that the mad or certain partr thereof are to be left open for further use. <br />In accordance with the above rules, Seneca Coal Company has designed and constructed all roads within the permit <br />area to approved CDMG criteria. These roads would provide long-term access for property owners and enhance the <br />proposed post-mining use of livestock grazing and wildlife habitat. When the haul road ox access road is no longer <br />needed for operations, Seneca Coal Company will conduct the following actions prior to Ieaving the road as permanent: <br />1, The top road surface will be not less than 20 feet in width, as appropriate. <br />2.
