CO 81073 <br />March 10, 2009 <br />Mr. Jared Ebert <br />Div. of Reclamation, Mining and Safety <br />Dept. of Natural Resources <br />Subject: Lusk pit, burrowing owls and ranch road <br />/RECEIVED <br />4AR 17 200,9 <br />Division of Kedamation, <br />Mining and Safety <br />- -- ---Dear Mr. Ebert; - - - - - - -- - - -- - - - - <br />As a result of a telephone conversation with our District Wildlife Manager, Jonathan <br />Reitz, I am submitting for inclusion into our Lusk Pit application this letter as a <br />supplemental to the DOW wildlife impact statement. <br />I agreed with Mr. Reitz that if should we encounter any burrowing owls in the permit <br />area we would make sure that we stay at least 75' away from the animal. Also, if our <br />crew finds an owl in the path of our operation, we would notify Mr. Reitz immediately <br />and give him an opportunity to remove the owl to a safer location. <br />On the matter of the two-track ranch road in the permit area, Mr. Lusk said that we <br />should mine through the road and that it would not be reestablished.
