ax ?-
Historically, Pond "F" has proven suitable for watering livestock. Pond
"F" is an approved design impoundment being a self de-watering pond
and does not contribute to degradation of downstream waters;
b) Sufficiently stable water level and a compatible pond configuration for
intended use;
Pond "F" has held sufficient water level for watering livestock during the
scheduled grazing seasons and is configured with wide and gentle sloped
shores for the cattle's easy access to the water;
c) Adequate safety and access for intended water users (i.e.,
livestock/wildlife);
The shores of the impoundment gently slope across the pond for safe and
easy entry of livestock and wildlife. Also, the shores and the embankment
are well vegetated;
d) Prevent diminution of water quality/quantity for any affected water rights
holders;
Pond "F", designed as an approved sedimentation pond, functions to settle
out sediment from water run-of thereby benefiting the water quality.
Being a self de-watering pond, when the approved water levellvolume is
reached, the pond discharges through the standpipe enabling the water to
flow on downstream.
e) Adequately sized impoundment for intended use:
As stated in (b) above, given that the livestock is scheduled to graze
through the Pond "F" area in a relatively short duration and typically early
in the grazing season, the size of the impoundment has been adequate;
Impoundment suitable for approved post-mining use;
I am informed that the approved post-mining use is for livestock and
wildlife, therefore I believe Pond "F" is well suited for the intended use.
Sincerely,
Daniel McCarty
SILVER SPUR LAND & CATTLE, L.L.C.
Cowdrey, Colorado
