Cattany <br />Division Director <br />Natural Resource Trustee <br />Due to the reassignment of lead specialist for the Marr Mine, due to staff departure, the Division <br />has reevaluated the status of TR22. While Rules 4.05.9(13)(b), (C), (E), and (F) have already <br />been addressed, and Rule 4.05.9(13)(d) is currently under consideration with the BLM and the <br />Colorado State Engineer, our review did not find Rule 4.05.9(13)(a) addressed. <br />In order to address Rule 4.05.9(13)(a), please acquire and include in the TR application, current <br />water quality information for Pond F to demonstrate compliance with the parameters of Table 1, <br />2 and 3, Regulation No. 31, 5CCR1002-31.
