(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-053 <br />INSPECTION DATE 3/4/09 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection occurred as part of the Division's routine monitoring of permitted operations. The Lyle <br />Smith Pit is approved for 58 acres affected land for the excavation and processing of construction <br />materials. Affected lands will be reclaimed to support rangeland post-mining land use. The Division <br />holds $83,100 financial warranty. The report is accompanied by a current reclamation cost estimation <br />totaling $80,735. <br />Public access to the permit area was controlled by locked gate. Mining and reclamation activities were <br />dormant during the inspection. As noted in the 2008 annual report, submitted by the Operator, mining <br />activities approach the western boundary of the permit area. Mining activities commenced at the eastern <br />permit boundary and as the active highwall advanced westward the north and south sides of the pit have <br />been reclaimed contemporaneously. The pit exhibited internal drainage. Various stockpiles of mined <br />and processed materials were located on the pit floor. Reclamation materials were stockpiled along the <br />north and south sides of the active highwall area and ready for an efficient down-hill push when needed. <br />The entire operation appeared to have advanced in an orderly, planned manner. <br />Pursuant to Rule 4.2.1(1), the Division has reviewed the current cost of reclamation, totaling $80,735. <br />Therefore, the existing $83,100 financial warranty appears sufficient to ensure completion of reclamation. <br />Please find enclosed, 12 pages of summary, worksheets and data sheets utilized by the Division to <br />estimate the current cost of reclamation. <br />No problems or possible violations were observed. <br />Please be aware that annual reports always require a map of current site conditions, regardless of <br />whether any disturbance has occurred during the report year. <br />Response to this inspection report should be directed to the Division's office in Durango at 691 County <br />Road 233, Suite A-2, Durango, CO 81301, to the attention of Wally Erickson, phone (970) 247-5469. <br />Please note the change of address for the Division's office in Durango. <br />I & E Contact Address <br />NAME Todd A.
