(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2008-085 <br />INSPECTION DATE 3/4/09 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This pre-operational inspection was conducted as part of the Division's review process for a Regular 112 <br />type permit application. The application for the Ft. Garland Pit proposes 23.3 acres affected lands for <br />excavation and processing of construction materials. On-site processing will include crushing, screening <br />and production of asphalt products. Affected lands will be reclaimed to support rangeland post-mining <br />land use. The pit area will exhibit internal drainage throughout the life of mine and afterfinal reclamation. <br />Surface and subsurface lands are owned by A.T. Investments, LLC, who have the same address as <br />Asphalt Constructors, Inc. Two photos accompany.this inspection report. <br />The condition of the proposed permit area appeared consistent with the descriptions provided in the <br />application. Permanent man-made structures located within 200 feet of the proposed permit boundaries <br />appeared limited to concrete lined irrigation ditches and historic fence lines in various states of disrepair. <br />The proposed permit area is bordered by undeveloped private lands to the north, east and west, and by <br />another permitted mining operation, the Southway Pit, M-1981-153, on the south. The Ft. Garland <br />Sanitation District waste water treatment facility is located well beyond the proposed east permit <br />boundary. <br />The south boundary of the Phase 1 area is also the north boundary of the Southway Pit. The current <br />reclamation plans for the two adjoining pits would leave a 3H:1 V ridge of material between the reclaimed <br />operations. Mr. Stockebrand discussed the potential for an agreement between Southway Construction <br />Company and Asphalt Constructors whereby both operations would remove the 3H:1 V ridge on each of <br />their adjoining sides, resulting in a continuous pit area with a common pit floor. The Division responded <br />that the proposed landform, with two adjoining pits sharing a common pitfloor,,would require modification <br />to both reclamation plans. <br />Please be aware that annual reports always require a map of current site conditions, regardless of <br />whether any disturbance has occurred during the report year. <br />Response to this inspection report should be directed to the Division's office in Durango at 691 County <br />Road 233, Suite A-2, Durango, CO 81301, to the attention of Wally Erickson, phone (970) 247-5469. <br />Please note the change of address for the Division's office in Durango. <br />I & E Contact Address <br />NAME Todd A.
