The issuance of this permit <br />does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from <br />seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval <br />of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation <br />Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137(2) on the condition that this well is operated in accordance with the Parkdale Project <br />DMG Na. M-97-054 substitute water supply plan approved by the State Engineer on September 28, 2004. This well shalt not <br />be operated unless it is included in a substitute water supply plan approved by the State Engineer or a plan for <br />augmentation approved by the water court. The subject water supply plan is currently valid through September 30, 2006, <br />and if not extended or if a court approved plan for augmentation is not in operation, diversion of ground water from this well <br />must cease immediately. <br />4) Approved on the condition that this well is operated in accordance with the Amended Rules and Regulations Governing <br />the Diversion and Use of Tributary Ground Water in the Arkansas River Basin, Colorado. <br />5) The use of ground water, in addition to the water contained in the mined product and evaporation, is limited to dust control <br />and gravel washing. No other use of water is allowed. <br />6) The pumping rate of this well shall not exceed 100 GPM. <br />7) The total combined surface area of the settling pond and wash pond is limited to 0.6 acres. <br />8) The average annual amount of ground water to be appropriated shall not exceed 40.67 acre-feet. <br />9) The owner shall mark the well (gravel pit pond) in a conspicuous place with well permit number(s) and court case <br />number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />10) A metering method must be established for this well pursuant to the Amended Rules Governing the Measurement of <br />Tributary Ground Water Diversions Located in the Arkansas River Basin. (Contact the Water Division 2 Office for a list of <br />approved well testers.) <br />11) Pursuant to Rule 17.1.4 of the Water Well Construction Rules, the owner shall submit, after initiation of construction, site <br />plan and cross section drawings on 8-1/2" x 11" paper showing the extent of intended excavation, the maximum depth of <br />the pit, and the initial static water level. <br />12) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well, completed in the same aquifer, <br />that is not owned by the applicant. <br />APPROVED <br />DDW <br />Receipt No. 05259: <br />At State Engineer <br />DATE ISSUED 10-18-2004 <br />By <br />EXPIRATION DATE 10-18-2005
