Cattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining, and Safety (DRMS) has received your Notice of Intent to Conduct <br />Prospecting (NOI). Our initial review indicates that it is incomplete. Please address the following items at your <br />earliest convenience bearing in mind that if you have not addressed these items within sixty days of the date of this <br />letter the DRMS may terminate this NOI (rule 5.1.3 of the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board). <br />1. Please mark the location of your prospecting operation on the enclosed map and return the map to the DRMS. <br />2. Please complete the enclosed W9 Form and return it to the DRMS. <br />Your NOI proposes the excavation of a 35 foot long by one foot wide by two foot deep trench, collection of rock <br />samples from the trench, followed by backfilling and reclamation of the trench area. Once you have addressed the <br />above listed items and have received written authorization from the DRMS to commence prospecting, the ground <br />disturbing activities approved under the NOI will be limited to the trench. DRMS has determined that the $200.00 <br />bond you have already provided is adequate financial warranty for reclamation of the trench. <br />When you and I met at the DRMS office on February 12, 2009, we discussed baseline hydrologic characterization in <br />the vicinity of your claims that would be necessary to support any future permit application to conduct mining. DRMS <br />recommends that you provide a sampling and analysis plan for review prior to initial sample collection in order to <br />better assure that the characterization will meet DRMS criteria. The sampling and analysis plan should describe <br />proposed sample collection points and their hydrologic relationship to the veins targeted for mining and to surface <br />disturbances, such as waste rock dumps, that might be associated with future mining. The plan should also describe <br />sample collection and preservation methods, field measurements to be made during sample collection, such as flow <br />rate from springs and pH of the sampled water, laboratory analyses to be conducted on the samples, number of samples <br />to be collected, and approximate schedule for sample collection. <br />If you have any questions, please contact me at 303-866-3567. <br />Sincerely, <br />Allen C.
