Per Rule 2.05.3(8)(a), please revise this page and any associated maps to reflect the appropriate
date the sub-areas will be utilized.
4. Please resolve the apparent discrepancy between page III-9 of the permit application which
refers to County Roads 97 and 73, and Map 1 which shows County Roads 96 and 78.
5. Please revise Section III.A.7.h (Damage Mitigation) so that the daily visual monitoring
requirement of County Road 65 also applies to County Road 96 (or 97, whichever road number
is correct).
6. Please update Section III.A.7.a to reflect mining progress. For example, change the text on
page 111-9 to say that Halandras Reservoir has been subsided.
7. Please submit an updated Map 120 showing the current extent of developed entries and mined
longwall panels per Rule 4.20.
8. Section III.A.7a discusses the anticipated subsidence of Halandras Reservoir and subsequent
repair work to be conducted as necessary. Please provide an update as to whether or not
damages were observed and repairs made as necessary.
9. Section IVY.1 of the PAP page IV-26 discusses the water supply system. It is noted that a
revised plan approved with MR-55, was abandoned and water is now pumped directly from the
surface water lagoon to the raw water system. Please revise the page to include information
discussing the appropriate approvals granted for the pumping directly from the surface water
lagoon to the raw water system and please provide any relative copies of subsequent approvals
for the design and use of the surface water lagoon and associated water delivery system.
10. Per Rule 2.04.4, please update descriptions of the cultural and historic resources listed or
eligible for listing on the National Register of Historic Places and any significant known
archaeological sites existing within all areas proposed or likely to be proposed by surface
activities or planned probable subsidence.
11. Per Rules 2.04.11(4) and 2.05.6(2), please update T&E species and discuss potential impacts to
current State and Federal Threatened and Endangered plant and animal species lists. The
Federal and State listed species of concern may have changed since the last revision. To find
the most up to date lists, the following websites may be helpful: http://www.fws.gov/mountain-
prairie/endspp/CountyLists/Colorado.pdf and
http://wildlife. state. co.us/WildlifeSpecies/SpeciesOfConcem/ThreatenedEndangeredList/ListOf
ThreatenedAndEndangeredSpecies.htm
If you have any questions feel free to contact me.
