Thompson Gravel Pit SUP Administrative Amendment <br />Permittee Name Change <br />Board of County Commissioners <br />DISCUSSION <br />Certificate of Recommendation <br />March 17, 2009 <br />The Thompson Properties Gravel Pit Special Use Permit was most recently renewed on November <br />10, 2008 by Grand County Board of County Commissioners Resolution No. 2008-11-10. The <br />ending date for the permit is December 15, 2009. <br />Since the time of renewal, the property ownership has changed twice. Those transactions are <br />described below: <br />• 12/10/08 - Thompson Properties, a Colorado General Partnership to Daniel L. Hahn and <br />Donna R. Hahn, warranty deed recorded at Reception No. 2008011562 <br />• 02/17/09 - Daniel L. Hahn and Donna R. Hahn to Reclamation Ridge, LLC, a Colorado <br />limited liability company, quit claim deed recorded at Reception No. 2009001398 <br />Based upon those property transfers, Georgia Noriyuki, representing Reclamation Ridge, LLC has <br />sent a letter requesting an administrative amendment to the permit, which will allow the permittee <br />name to be changed to Reclamation Ridge, LLC, a Colorado limited liability company. <br />COMPLIANCE WITH GRAND COUNTY ZONING REGULATIONS <br />The Grand County Zoning Regulations state that "An administrative amendment can be considered <br />when there are changes to the original permit, such as but not limited to a change in the name of <br />the Permittee or other minor changes that do not otherwise affect the operation of the permit." It is <br />staff's opinion that this request is in compliance with the regulations. <br />STAFF COMMENTS <br />Per the Colorado Secretary of State Business Center, Reclamation Ridge, LLC is in "good <br />standing", with said LLC being formed on January 28, 2009. Staff would like to reiterate that the <br />only change being considered is the permittee name. No other changes to the permit or permit <br />conditions are being considered with this application. If this name change is granted, Reclamation <br />Ridge, LLC will be required to comply with all permit conditions as listed in the Thompson <br />Properties Gravel Pit Special Use Permit. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the permittee name change for Thompson Gravel Pit Special Use <br />Permit from Thompson Properties to Reclamation Ridge, LLC, a Colorado limited liability <br />company with the following condition: <br />1. All other terms and conditions as contained within the existing Thompson Properties Gravel <br />Pit Special Use Permit, Grand County Board of County Commissioners Resolution No. <br />2008-11-10, recorded at Reception No. 2008011330 shall remain in full force and effect.
