Cattany <br />Division Director <br />Natural Resource Trustee <br />UG, Leve16 Hydrologic Characterization Report, <br />The Division's Denver office received your written request for additional time to respond to Division <br />staff's memo, in which numerous questions and concerns were raised, about the above-named report. <br />LKA International was required to prepare the report to begin to characterize and define the hydrologic <br />regime and propose necessary measures to address water quality issues that could be attributable to the <br />mine. Recall, the report was a requirement to identify, in part, various possible sources of water and <br />contamination, and any applicable and appropriate methods to address them. The report and the <br />approved follow-up activities are part of the corrective actions stemming from problems noted in the <br />report issued for the June 8, 2007 inspection, and are still outstanding and must be completed. Failure <br />to diligently pursue completing the corrective action may result in additional enforcement by the <br />Division. <br />The hydrology report was received by the Division on December 11, 2008, at which time staff review <br />began. The Division's response was sent to you on February 9, 2009, including an enclosure detailing <br />staff's review questions and concerns, and stating that the deadline for receiving your responses is <br />March 16, 2009. Your request asks that the deadline be extended until June 15, 2009. The Division <br />will approve an extension, but it is a 30-day extension The new deadline date is now set for April 15 <br />2009. Due to the short construction season at the site, a long extension could cause undue delays in <br />onsite activities and is therefore not considered appropriate. <br />The Division's review asked for clarifications of methodology and supporting documentation for <br />conclusions drawn in the hydrology report. The conclusions in the report were drawn from the <br />information obtained prior to the report. There is no need for additional data gathering to respond to <br />the Division's review. <br />For gulch liner effectiveness questions, please provide what data you have to demonstrate its <br />performance.
