Exhibit E - Reclamation Plan <br />The original approved seed mixture is retained in the Amendment. An optional <br />seed mixture is provided under Exhibit L - Addendum C(2): Re-vegetation Seed <br />Mixture. This optional mixture will be applied at the option of the Operator over <br />failed seeding areas following the use of the original seed mixture previously <br />approved by the Division. While the original seed mixture may be applied to <br />failed areas as well, and is accounted for in this manner under Exhibit L - <br />Reclamation Costs, the Optional mixture provides for the use of other genetic <br />potential and combinations under failed conditions. A wheatxwheatgrass sterile <br />hybrid will be combined with the applied mixture as a substitute for the use of <br />mulch. <br />All affected lands remaining above the anticipated final water level of the ponds, <br />and not otherwise occupied by existing or planned mixed uses, will be re-vegetated <br />with the approved seed mixture(s) for general agriculture. Mixed use(s), other than <br />general agriculture, may include, but is not limited to, the retention of existing <br />structures as desired (e.g., concrete batch plant, shop, scale-house/office, and <br />supporting facilities (fuel depots, parking areas, oil and gas facilities access, etc.) <br />for continued industrial - commercial use (as supported by existing approved Weld <br />County Building Permits); the creation of unforeseen future structures, and for the <br />use and development of on-site water resources. Since the area of surrounding <br />lands is a mix of these uses as well as light residential, the site end use will retain <br />these potentials (refer to Exhibit F - Reclamation Plan Map). <br />The rate of reclamation will follow concurrently with extraction and the respective <br />timetables identified for extraction under Exhibit D - Mining Plan. All timetables <br />are contingent upon market conditions, therefore, a probable range of time is <br />indicated. With extraction activities anticipated to take up to 30 years to complete, <br />reclamation will add an additional five years minimum to this estimate, bringing <br />the anticipated life of the mine to 35± years. <br />Overall, the Amendment clarifies and details the nature and progression of <br />reclamation over the affected lands in a manner substantially lacking in the original <br />application. In this manner, the capacity of the operator to meet the objectives of <br />the Amended plans is greatly enhanced, and will be a great asset to the successful <br />completion of operations and the eventual release of the attending financial <br />warranty and respective DMG Permit. <br />Because the state of disturbance reached its near maximum extent shortly before <br />the succession of operator's by Varra Companies, Inc., in October 1999, the <br />progressively improving reclamation of the property is evidenced in Exhibit L - <br />Varna Companies, Inc. DMG Permit M78-056 2003 Amendment 2
