STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
Interoffice MEMORANDUM
to: Janet Binns
COLORADO
DIVISION OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
Governor
Harris D. Sherman
Executive Director
from: Byron G. Walker
Ronald W. Cattany
subject: Eagle Mine Complex, C-1981-044, SL-2 Adequacy Responses Division Director
date: January 31, 2006 Natural Resource Trustee
Janet, this memorandum is in response to your memorandum of 1/13/2006, same subject. I
believe the response from the applicant is adequate.
Request 15 was made to provide us with a clearer understanding of subsidence observed in the
area. We should be able to generate, within house, such depictions. However, in review, I do not
believe we have to. I found no evidence in the PAP or the request that the subsidence features
were not within the approved subsidence control plan (there were no specifics with regard to
protection of rangeland). Approved postmining land uses appear to be feasible. There was no
indication of material damage or requirement for restoration of renewable resource lands or
structures.
With regard to item 16, the applicant has responded that the areas being released are not affected
by fluctuations in the mine water. Our concern was that alternate wetting and drying of the
remaining coal pillars might result in collapse of more areas.
The applicant has indicated that subsidence has manifested itself over the area requested for
release.
All materials supplied and borrowed have been returned to you. Please see me if you have any
questions.
Cc: Dan Hernandez (w/o encl)
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
