Box 535 Division Director <br />Somerset, Colorado 81434 Natural Resource Trustee <br />RE: Elk Creek Mine, Permit No. C-1981-022, Oxbow Mining LLC <br />2007 Annual Reclamation Report, Adequacy Review <br />Dear Mr. Kiger: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of the <br />2007 Annual Reclamation Report (ARR) for the Elk Creek Mine. In. general, the report is complete and well <br />organized. However, the Division has two comments: <br />In the CDRMS Annual Reclamation Report for the Year 2007 form, a value of 155.08 acres is used for <br />the category "Acreage in long-term mining or reclamation facilities". It appears that this value should be <br />98.53 acres. This category accounts for the acreage that has been disturbed for facilities and has not <br />undergone any backfilling and grading. This value is derived from the calculation that the total disturbed <br />acreage ("Cumulative Total" of "Acres disturbed", or 155.08 acres) is equal to the summation of the <br />backfilled and graded acreage ("Cumulative Total" of "Acres backfilled and graded", or 56.55 acres) <br />plus the acres disturbed for facilities and not backfilled and graded ("Acreage in long-term mining or <br />reclamation facilities", or 98.53 acres) plus the acreage for surface mining pits and spoil not backfilled <br />and graded ("Acreage in active mining areas", or 0 acres). Please revise the form in question. <br />2. On page 4 of the 2007 ARR, a total of 55.03 acres is given for the "Seeded Areas" category. It appears <br />that this value should be 56.55 acres.
