On February 26, 2009, the Division of Reclamation, Mining and Safety received your
112 Construction Materials Reclamation Permit Application Package for the Heintzelman
Project (Pit 116), File No. M-2009-018. The application was filed for review on March
11, 2009. The decision date for your application is scheduled for June 9, 2009.
Newspaper publication of a notice regarding the filing of your application and transmittal
of a copy of the notice to all owners of record of surface rights and all owners of record
of lands within 200 feet of the boundary of the affected land is required within 10 days
after the Office notifies the Applicant that the application is considered filed. This notice
must be published once a week for four (4) consecutive weeks. The final date for receiving
comments is the 20th day after the fourth publication or the next regular business day.
You must submit proof of the notice and mailings to the Division prior to the decision
date. Additionally, any changes or additions to the application on file in our office must
be reflected in the public review copy which has been placed with the Weld County Clerk
and Recorder.
The Division is reviewing your application to determine whether it is adequate to meet
the requirements of the Act. We will contact you if additional information is needed.
