SAC is required to deruonstrate <br />that the levels of total suspended solids contributed by the reclaimed area to runoff or strearnflo?v <br />outside the permit area is less than or cainparable to ?e pre-mining condition or levels <br />documented for comparable adjacent areas, This can be demonstrated different v?ays. <br />?? chose to use background levels of ?' ? upstream from the reclaimed area and compare those <br />to the last fve years ofdata far three discharging ponds. This is an acceptable approach; however <br />Attachment F in the bond release application only provides data for the post-mine reclaimed <br />condition. states on page l 5 of the application that background levels were higher but does <br />oat provide the Dlvlslan V?rth the rnformat1011 necessary to substantiate this statement. The <br />Division will need the following information. <br />l . Please provide the actual water quality data and sample locations for the background <br />level infarmatian referenced in the water quality demonstration on page ? 5 of the hand <br />release request, and provide an actual comparison ofTS monitoring results that reflect <br />pre-mining conditions versus the reclaimed past-mina conditions to show carripliance <br />with Rule 3.a3.1(?}fib}, <br />Please call if you have any questions. <br />sincerely, <br />{ <br />lVlichael P.
