Permit M--1977-151
Mr Mount:
The City of Greeley has requested us to prepare documents of damages to our
property for them in regards to their installation of the 36 inch sewer line
on our property located at 2220 0 Street in north Greeley.
In early September 2006 we spoke with Rick Wenzel regarding mining within 200
foot of manmade structures as the City of Greeley was anticipating construction
of the sewer line which would run along the north boundary line and the west
end of our property.
At that time Mr Wenzel indicated there would have to be a 200 foot set back to
remain in compliance with the State Standards.
In 2002-2002 dredging was done approximately 50 foot deep in part of the lake
and plans are to do more in the near future - what is the difference with the
sewer pipe now being there. It is our understanding our mining permit, when
issued, allowed for 50 foot set back and now this could be 200 foot.
Would it be possible for you to visit the site and determine the damages incurred
to us via the sewer line construction of the City.
We would appreciate receiving a letter from you stating any restrictions and/or
limitations we now have as permitted by the State Standards. What has the
installation of the sewer line altered regarding our mining permit.
Enclosed is the as-built maps of the sewer line construction with distances for
you to review.
We may be reached at our Lamar office 719/336-3467 or Rex via cellphone 970/381-5992.
Thank you.
Respectfully,
r
i 8t?1 t I,y U"1
Rex M Hiner
enclosures
RMH/sah
