Elk Mountain Cattle Company
P.O. Box 514
Hartsel, Colorado 80449
(719) 836-2625
June 12, 2008
Mr. John P. Ary
Hard Rock Paving and Redi-Mix, Inc.
826 Mackenzie Avenue
Canon City, Colorado 81212
RE: Park County Rezoning and CUP - Permission to Sign Applications from Land
and Mineral Estate Owner - for DRM&S 112 Permit, # M-1984-101 TR2; a 66.80
acre site located in the N/2 of Section 18, T12S, R74W, 6th P.M.
Pursuant to a request that a signed notarized authorization letter be provided from the
property owner to Hard Rock Paving and Redi-Mix, Inc. allowing Hard Rock to sign the
Rezoning Application. (item 413: Park County Planning Office - May 30, 2008 Letter).
. Please be informed that this letter provides authorization for Hard Rock Paving
and Redi-Mix, Inc to sign applications for a Park County Application for Rezoning and
also for the CUP Application. Mine Zoning is being requested by Elk Mountain for the
life of the DRM&S 112 Mining Permit at the above referenced site. The Rezoning
Application has been signed by myself as the landowner and Hard Rock does not actually
need to sign anywhere on the submitted Rezoning Application. This letter is provided, as
requested, by item #13 in the Park County Planning Office Letter dated 5/30/08..
The associated CUP application is to operate Asphalt and Concrete plants as
necessary at the 66.80 acre 112 area being rezoned for mining. Hard Rock Paving and Redi-
Mix, Inc. has signed the CUP Application, as they operate the permitted site under
agreement. The 3/5/2008 Pit Agreement between Elk Mountain Cattle Company and Hard
Rock Paving and Redi-Mix, Inc. already allows for Hard Rock to operate the pit. Please
contact me if you have any questions at (719) 836-2625. Thank you, Regards.
Monte Downare
Partner/Owner
The foregoing instrument was acknowledged before me this day o Gf 42008 By Monte Dwnare as
the owner/partner of Elk Mountain Cattle Company
xpires:4 j . , C? `
