XIX. EXHIBIT S - PERMANENT MAN-MADE <br />STRUCTURES <br />The purpose of this Exhibit is to specifically identify permanent man-made structures <br />within 200 ft of the proposed permit (property) boundary and address any issues relative <br />to their protection and/or relocation as a result of proposed amended mining and <br />reclamation activities. The following manmade structures are, thus, identified below for <br />this proposed amended operation: <br />¦ Thirteen residential and commercial structures have been identified within 200 ft <br />of the permit boundary as shown on Figure C 1 Parcel numbers and property <br />owner addresses for these structures are included in the information provided in <br />Exhibit C - Pre-mining Plan. All of these structures are at least 50 ft from the <br />permit boundary and at least 75 to 100 ft from proposed mining limits and their <br />stability will not be affected by mining as discussed further below in the <br />Geotechnical Stability Exhibit. All owners of these structures will be notified by <br />mailings about the proposed affected land during the 10 days following submittal <br />of this application per Colorado Mined Land Board rules. <br />¦ Third Creek runs along the northeast side of the new expansion area and falls <br />within 200 ft of the proposed mining operation. The mining plan includes a <br />minimum 50 ft geotechnical setback from the creek where it runs through the <br />property that will protect the stability of the creek. <br />¦ The McCann Ditch currently runs through the property, but will be relocated <br />under a Nationwide (46) 404 Permit from USACE. A new easement for the ditch <br />will be established when it is relocated. Ready Mixed has permission from the <br />McCann Ditch Company to relocate the ditch and to mine within 50 ft of either <br />side of its existing or new location. A Carriage Agreement between the ditch <br />company and Ready Mixed Concrete Company to that effect is included in this <br />Exhibit. <br />¦ Spier Single Family Residence is of particular emphasis because it will be <br />surrounded by active mining. The closest structure on this property is at least 50 <br />ft from the permit boundary. With the minimum 25 ft mining setbacks proposed <br />64
