Glass" <sgiass@gaultgroup.com>, George Tsiolis <gtsiolis@nj.rr.com>, <br />Allen Cap <capallen @frontier. net> <br />Bob, <br />In response to your letter dated February 9, 2009 and the attached DAMS comments/questions on the report referenced above, I would like to <br />request that you give us some additional time to respond. The reasons for this request are as follows; <br />1) We are in the process of constructing the gulch diversion and pad-seep prevention measures that were the subject of (conditions) of our recent <br />permit expansion. Once the construction has been completed we will be able to determine it's effectiveness in diverting gulch water, stormwater <br />runoff and any toe seeps at the base of the pad as well as its acid neutralizing effectiveness. This will be required to accurately address some of <br />your comments/questions. <br />2) The ground is currently frozen and there is no way to monitor water (surface or subsurface through our existing piezometer wells) until the <br />spring thaw. As you know, the water flows in this particular area typically reach their high point in mid to late June. There are currently no water <br />flows in the areas of interest that we've been able to observe. Observing water flows will enable us to more accurately address some of your <br />comments/questions. <br />3) LKA is a small company with limited resources and can not afford to conduct all of these activities (construction, water monitoring and provide <br />technical responses to DAMS comments/questions) at or around the same time. We would prefer to take them one at a time and in a manner that <br />will produce the most effective and affordable results.
