March 2, 2009 <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />RE: 112 Annual Fees and Report <br />To Whom It May Concern: <br />0911AR - 5 P,"a 1:34 <br />-' -Recent accelerated activity along-with-abrupt changes-of the-deposit requested-a-tour - - - - - -- of the pit by field representative Wallace H. Erickson accompanied by Sky Ute Sand & <br />Gravel representative Michael Matheson. A site tour was conducted in December to show <br />the extent of change and how they were proceeding with the reclamation and mining <br />progress. An additional bond calculation along with a third party bond was issued as a <br />letter of credit to cover until reclamation can be caught up to the original mine plan. <br />Several enhancements to the plan include the French drain (noted in the inspection to <br />capture run off water), the use of fine sand and silts blended with the overburden to <br />enhance the soil under the placed topsoil, and the addition of a French drain along the toe <br />of the east boundary to collect and drain water traveling along the surface of the Mancos <br />Shale formation below the alluvial deposit. This will help keep from impounding water <br />behind the slope and allow for irrigation to occur from the base of the lower elevation. <br />The crushing spread has relocated to the south allowing for a shorter haul to <br />processing and reclamation to proceed in its previous place. The asphalt has been <br />recycled along with the concrete allowing the storage area to be graded for topsoil <br />placement. Overburden currently being stripped is being placed along the back slope <br />along the east side and for contouring the floor. <br />The map has added features of ponds, roads, ditches, and fences for references in <br />addition to those of the pit boundary. <br />Thank you, <br />"!F I J. <br />Rick Noland <br />President <br />Noland Inc.
