Cattany <br />Oak Creek, CO 80467 Division Director <br />Natural Resource Trustee <br />Re: Foidel Creek Mine, Permit No. C1982-056, MR236 adequacy concerns <br />Dear Mr. Nettleton: <br />The Division has reviewed Twentymile Coal Company's (TCC) application for a minor revision, MR236. <br />This revision proposes to install a meteorological station to the south of Pit 1, and includes Nitrogen <br />injection systems as required by MSHA at the 6MN and 18RT Mine Atmosphere Control (MAC) <br />boreholes. <br />The Division identified a few concerns with the submitted application as follows: <br />In Table 49A "volume to be added" column, TCC shows 293 cy topsoil to be added to SF-3. But <br />this additional topsoil has not been added into the total of 4,910 cy. This column should add up to <br />6,202 cy. The total stockpiled volume for the Total Volume column for the first table (facilities <br />area topsoil stockpiles) should equal 556,615 cubic yards. Please make the corrections to Table <br />49A. <br />2. The reclamation cost estimate included with MR236 shows 484 cubic yards of topsoil to be <br />replaced on the regarded met. station pad and road. Table 49A shows only 293 cubic yards of <br />topsoil to be added to the topsoil stockpile SF-3. Please explain this 191 cubic yard difference. <br />3. The Division is have difficulty blending revised (MR236) pages (revised date 2/23/2009) with <br />approved pages in the PAP. Pages 2.05-45.5f, 2.05-45.5g, 2.05-45.7 and 2.05-45.8 don't blend <br />with approved pages, or previously approved text has been lost. The Division is including copies <br />of the approved pages with this letter. We recognize that this has been an ongoing problem but <br />have identified these specific concerns with the MR236 revised pages. We also recognize that the <br />specific page numbers are not as critical as assuring that all text is retained. Specific pages are <br />referenced to assure that Division and TCC are looking at the same information. <br />A. Revised page 2.05-45.6f has eliminated the text approved during MR08-227 (rev. 1/8/08) <br />regarding the Temporary Shaft Heater Installation. However, this revised page has <br />reinstated text approved in TR61 that discusses the piping to the 6MN million gallon tank <br />and 6MN Water Storage Reservoir.
