One of.the stipulations identified in the Decision states that vegetation-removing activities will <br />not be conducted between about December 1 and about April 15. This restriction is enforced at the <br />discretion of the Authorized Officer. The purpose is to minimize impacts to wintering mule deer and elk. <br />A contract renewal had not been issued at the time of this conversation. <br />On January 15, 2009, you spoke with Helen Mary Johnson (BLM Geologist). You requested that the <br />BLM consider an exemption for a timing restriction. As part of your proposal, you indicated that you <br />would only remove up to four of the fifteen acres which have been identified for the contract renewal. <br />On February 19, 2009, BLM staff (Matt Janowiak, Acting Field Manager), Skip Fischer (Wildlife <br />Biologist), and Helen Mary Johnson (Geologist) conducted an inspection of the proposed area. It was <br />determined that snow cover is currently low and animals will be able to disperse onto extensive areas of <br />similar range. <br />A renewal for the Montoya Pit contract will be issued today. In addition, the BLM will grant an <br />exception for the timing restriction described above.
