Specific reclamation items related to <br /> slopes, pollution prevention, and dam safety are also complete at this time. This letter, and <br /> supporting documentation, are packaged for Division review. CMC is pleased to provide this <br /> documentation to secure closure to the 1993 Technical Revision TR-05 for Oxide Tailing <br /> Removal. <br /> CMC seeks concurrence on the part of the Division that Eagle Park Reservoir and 4-Dam meet <br /> criteria for an approved post-mining and beneficial land use of developed water resources. The <br /> data provided will demonstrate that, while areas around and adjacent to the reservoir remain <br /> subject to performance standards for vegetation, tailing removal from the reservoir has resulted in <br /> water quality that meets or exceeds target levels of performance. Other performance measures <br /> associated with the project are documented with this package. CMC also seeks concurrence that <br /> the appropriate measures are in place to protect reservoir water quality from upstream mining <br /> impacts through approved Environmental Protection Facilities, stormwater management, and <br /> operational control of affected lands above the reservoir. <br /> In review of inspection reports and other correspondence, an attempt has been made to address <br /> all topics related to the reservoir on a point-by-point basis. CMC believes that topics of Division <br /> concern brought forth over the past three years have been addressed. CMC seeks closure and <br /> Division concurrence for what we recognized as a unique and exemplary model of mine <br /> redevelopment in the State of Colorado. Per our discussions during your visit to Climax on May <br /> 7, 1997, CMC has maintained water levels and operational controls on the reservoir to prevent <br /> the delivery of water into the Eagle River Basin until such time as the Division of Minerals and <br /> Geology agrees with CMC's determination that the Eagle Park Reservoir meets acceptable <br /> criteria in post-mining land use and water quality. <br /> CMC is exploring purchase-option agreements with downstream water users for the sale of the <br /> reservoir. Our intent is to work with the Division in establishing all pertinent and appropriate <br /> documentation for the Eagle Park Reservoir project that facilitates return of this affected land to <br /> intended and functional post-mining land use.
